Description of Service

Our site provides the user with a service to allow pet indentification using the www.getmeknown.co.za online database

Services are Free with no monthly nor any annual fees, if we need to ask a small service fee in the future we will provide a 3 months notice.

We provide users to register manageable accounts/profiles to register Pet Microchip and Tags that are linked to that their profile for owner idenification.

When a User visits the site and search for the Micochip and/or Pet Tag the owners contact information is displayed to them.

Use of this Service

The user agrees to, when using this service:

• I/We warrant that the information is given on the any posted information is true and correct.
• I/We are am/are aware of the fact that the terms and payment are strictly advance payment for any products like the Scanner + Microchips.
• Anyone purchasing Microchips, having completed an application as "Registration as User of GetMeKnown" and confirms that he/she has sufficient knowledge / instruction / experience to implant microchips or has sought such veterinary advice and instruction which shall enable him to competently perform the procedure.

Although reasonable care has been taken to ensure that the site is secure we are not responsible for the content our users supply. We will not be held responsible for any invalid or offending content.

We disclaim all liability and responsibility to any person or entity with respect to any loss or damage caused, or alleged to be caused, directly or indirectly, by the use of this service and or products. We provide only this lookup service and not the physical return of your pet.

Warranties and Limitation of Liability

You understand and Agree that your use of this service is entirely at your own risk and that our services are provided "AS IS" and "AS AVAILABLE" which means that the information contained on or provided through this service is intended for consumer informational use. All access to this site is voluntary and at the sole risk of the user. We do not make any express or implied warranties, representations or endorsements of any kind whatsoever (Including without limitation, warranties of title or noninfringement, or any warranties of merchantability or fitness for a particular purpose) with regard to the service. Or with respect to any information, product, service or other material provided on or through the service we do not warrant or guarantee the accuracy, completeness, correctness. Time lines or usefulness of any information, products, services, or other material provided throught the service or on the internet generally. We make no warranty or guarantee that the service will be uninterrupted. timely, accurate, secure or error-free or that defects in the service will be corrected. We are not Liable to any user or anyone else for any decision made or action taken by you basaed on reliance upon the information contained on or provided through the service.

Intellectual Property / Proprietary Rights

By uploading any file/materials to the GetMeKnown site you grant to GetMeKnown a worldwide, fully paid-up, exclusive, royalty-free, sub-licensable and transferable license to use, reproduce, distribute, modify, prepare derivative works. (Which will be used mainly for advertisements or promotions). GetMeKnown will take no liability for any third-party that claims such work.

You acknowledge and agree that www.GeMeKnown.co.za may contain proprietary and confidential information including trademarks, service marks and patents protected by intellectual property laws and international intellectual property treaties. We authorize you to view and make a single copy of portions of the service for offline, personal or non-commercial use. Our content may not be sold, reproduced, or distributed without our written permission. Any third-party trademarks, service trademarks and logos are property of their respective owners. Any further rights not specifically granted herein and reserved.

Customer information/communications

Emails are send as part of the functionality of the www.getmeknown.co.za website and is embedded as part of my user profile. I agree to receive these emails once I created my own profile. These are considered transactional and part of the functioning of the system but can be disabled at any time by logging into your profile should you wish.

When you join the service your email is added to our mailling list, all emails sent in this regard will always have a unsubscribe link present. When you unsubscribe your email is deleted from the list but will still be in the system to allow normal functioning with microchip registration.

Please contact us should you wish to totally remove your account, please note microchips registered to your account will need to be either transfered to a new owner or totally deleted in this case.

Liability

GetMeKnown guarantees all products supplied against defects in materials and workmanship for a period of six months ( microchips have life long replacement warranty ) from the date of delivery. GetMeKnown's sole liability in respect of such guarantees shall be to replace or repair (at it's sole discretion) of any defective product to returned to it. GetMeKnown shall have no liability in respect of death, damage or injury to any animal occasioned through the implant or any device supplied to it, unless such death, damage or injury can be shown to have caused through GetMeKnown gross negligence or willfull act.

You agree that GetMeKnown has no responsibility or liability for the deletion of, or the failure to store or to transmit, any Content and other communications maintained by the Service. GetMeKnown retains the right to create limits on use and storage at our sole discretion at any time with or without notice.

GetMeKnown does not endorse, support, represent or guarantee the truthfulness, accuracy, or reliability of any communications posted via the Service or endorse any opinions expressed via the Service. You acknowledge that any reliance on material posted via the Service will be at your own risk. Your access to any service or use of our products binds you to all our terms and conditions.

You will not hold us or any of our affiliates, subsidiaries or patent company liable for damages including (but not limited to) loss of wages, revenue or business because of any services related to or provided by this site.The sole and exclusive remedy for dissatisfaction with the services of this site will be for you to stop using the service. You understand and agree that we and any of our subsidiaries or affiliates shall in no event be liable for any direct, indirect, incidental, consequential, or exemplary damages. This shall include, but not limited to damages for loss of profits, business interruption, business reputation or goodwill, loss of programs or information or other intangible loss arising out if the use of or the inability to use the service, or information, or any permanent or temporary cessation of such service or access to information, or the deletion or corruption of any content or information, or the failure to store any content or information, The above limitation shall apply to whether or not we Have been advised of or should have been aware of the possibility of such damages. In jurisdiction where the exclusion or limitation of liability for consequential or incidental damages is not allowed, our liability is limited to the greatest extend permitted by law.

The user needs to ensure that update to date virus software is present and Indemnify GetMeKnown from any damages caused by any virus.

Indemnification

You agree to indemnify us and any of our parent or subsidiary companies or organizations, and any of our successors, assigns or licensees, together with any of their respective officers, directors and employees, against any damages, losses, liabilities, judgements, costs or expenses (including reasonable attorney's fees and costs) arising out of a claim by a third party related to the use of the Service, or any breach or violation of this Agreement by you or any other term or condition contained in this service.

Information and Forbidden Actions using Information in the GetMeKnown Database

1. This service was Developed for use by Pet Owners and People who found lost pets and to proove ownership. Your access to any service or use of our products binds you to all our terms and conditions.

2. It is Forbidden to use any the information obtained from the site about a pet owner to send SPAM or any other promotional service that does not carry our consent.

3. If any such activity is found we will immediately report it to the appropriate authorities with all the IP logs and Cookie information we have about the user that committed these acts. No Personal Information about any of our other users will be given out.

4. Activities deemed Forbidden include, but not limited to:

   • Use of Pet Owner Details to promote Services or Products that do not carry our consent.
   • Collecting of Pet Owner Information to add to or create list of Customer Contacts (Namely for Promotions)
   • Any Actions that could lead to the exposing of personal information of users stored in the site.
5. Please Note we our affiliate products/services (getmehome.co.za) may use the information as we seem fit.

GetMeKnown we will not sell, redistribute or Give Away and personal data of any of our users.

We reserve the right to modify and amend Privacy Policy and Terms of Use at any time without notice. It is your responsibility to remain informed of current Privacy Policy and Terms of Use.

While GetMeKnown strives to protect your personal information, as outlined here, we cannot guarantee or protect the security of any information you post on our website as it's accessible (Limited but enough for them to be able to contact you) by anyone that knows the number of your microchip. So be careful of posting any personal or sensitive information.

If you violate any laws or perform any illegal activities, GetMeKnown reserves the right to disclose any user activity to related parties and law enforcement agencies.
